SI 2024/41

SI 2024/41. The Higher-Risk Buildings (Keeping and Provision of Information etc.) (England) Regulations 2024.  Comes into force 16th January. These Regulations define the information and documents the principal accountable person (“PAP”) and any other accountable person (“AP”) for a higher-risk building must keep in relation to that higher-risk building.

SI 2024/47

SI 2024/47. The Biodiversity Gain Requirements (Exemptions) Regulations 2024.  Comes into force 12th February. These Regulations, which apply in England only, exempt certain developments from meeting the biodiversity gain requirement that would otherwise be imposed as a general condition of planning permission.

Amendments to the Planning Act 1990 covering biodiversity

SI 2024/48. The Biodiversity Gain Requirements (Irreplaceable Habitat) Regulations 2024.  Comes into force 12th February. These Regulations define “irreplaceable habitat” for the purposes of Schedule 7A of the Town and Country Planning Act 1990 (A 1990 c.8) and modify its application in respect of habitat falling within the definition.

SI 2024/49. The Biodiversity Gain (Town and Country Planning) (Consequential Amendments) Regulations 2024.  Comes into force one commencement of Schedule 14 to the Environment Act 2021. Amends the Town and Country Planning Act 1990 (A 1990 c.8), Sections 73, 78, 284 and 336. Amendments cover the duties on local planning authorities for biodiversity gain in England.

SI 2024/50. The Biodiversity Gain (Town and Country Planning) (Modifications and Amendments) (England) Regulations 2024. Comes into force 12th February. These Regulations modify Part 2 of Schedule 7A the Town and Country Planning Act 1990. Amendments cover phased approval of planning applications or where conditions associated with a planning application require phased approval.
