SI 2023/1170

SI 2023/1170. The Environment Act 2021 (Commencement No. 7) Regulations 2023.  Comes into force on 3rd November.  Subsections 1 and 2 of Section 82 (monitoring quality of water potentially affected by discharges), Section 98 (biodiversity gain as condition of planning permission), Section 100 (biodiversity gain site register) and paragraphs 1 and 2 of Schedule 14 (biodiversity gain as condition of planning permission).  Comes into force 30th November. Section 115 of the Act (local highway authorities in England to consult before felling street trees).

SI 2023/1182

SI 2023/1182. The Energy Savings Opportunity Scheme (Amendment) Regulations 2023.  Comes into force 29th November.  These Regulations amend Regulations 4 (compliance periods), 8 (Notification System), 10 (publication of information), 21 (role of lead assessor and estimates), 25 (identification of areas of significant energy consumption) of The Energy Savings Opportunity Scheme Regulations 2014 (SI 2014/1643)  and adds new sections on calculations related to organisational purposes and the requirement on all participants to produce an ESOS action plan.  The amendment also updates Schedules 2, 3 and 5.

SI 2023/1244 and SSI 2023/336

SI 2023/1244. The Producer Responsibility Obligations (Packaging Waste) (Amendment) (England and Wales) Regulations 2023. Comes into force 1st January 2024. These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (SI 2007/871). They amend the recycling target levels in Schedule 2.

SSI 2023/336. The Producer Responsibility Obligations (Packaging Waste) Amendment (Scotland) Regulations 2023. Comes into force 1st January 2024. These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations 2007 (SI 2007/871). They amend the same recycling target levels in Schedule 2 as amended by SI 2023/1244.

SI 2023/1197

SI 2023/1197.  The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) (Amendment) Regulations 2023.  Comes into force 6th December. These Regulations amend Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012 (SI 2012/2920). All existing fees payable to local planning authorities in respect of applications, deemed applications, requests or site visits relating to major development are increased by 35%. All other existing fees are increased by 25%. A new provision is added so that, from 1st April 2025, all fees under those Regulations can be increased annually. The amount of any increase will be in line with inflation, or if lower, 10%.
