The Energy Act 2016 (Commencement No. 1 and Savings Provisions) (Amendment) Regulations 2016.

The following provisions of the Energy Act 2016 come into force on 12th July 2016—

(a)subsections (1) to (3) of section 1 (the OGA),

(b)section 3 (transfer of property, rights and liabilities to the OGA),

(c)section 4 (transfer of staff to the OGA),

(d)section 5 (transfer schemes: supplementary),

(e)section 13 (levy on licence holders),

(f)section 14 (the licensing levy: regulations), and

(g)section 78 (onshore wind generating stations in England and Wales).”.

SI 2016/721. The Dangerous Goods in Harbour Areas Regulations 2016. Coming into force 1st October. These Regulations modernise the control of carriage and the handling of dangerous goods in harbour areas in England, Scotland and Wales and replace the Dangerous Substances in Harbour Areas Regulations 1987. The Regulations are divided into six parts. • Part 1 (Interpretation and application – regulations 1-6) • Part 2 (Entry of dangerous goods into harbour areas – regulations 6-7) • Part 3 (Marking of vessels – regulations 8-9) • Part 4 (Emergency and untoward incidents – regulations 10-13) • Part 5 (Explosives – regulations 14-24) • Part 6 (Miscellaneous and general – regulations 25-35)

The Renewable Heat Incentive Scheme (Amendment) Regulations 2016. Comes into force 1st August. Amends Regulation 39 of SI 2011/2860 with respect to periodic support payments.

The Waste (Meaning of Recovery) (Miscellaneous Amendments) Regulations 2016. Comes into force 3rd August. These Regulations make amendments to the Sis listed which define waste “recovery” by reference to Directive 2008/98/EC l on waste (“the Waste Framework Directive”). Annex II to the Waste Framework Directive was amended by adding a climate correction factor into the energy efficiency formula used to determine whether an incineration facility dedicated to the processing of municipal solid waste is considered a recovery operation (recovery operation “R1” in Annex II).
