A 2023 c.53. Energy Act 2023. Comes into force as listed in Section 334 of the Act. This Act covers the licensing of carbon dioxide transport and storage (Part 1),  the capture and storage of carbon dioxide and the production and transport of hydrogen (Part 2), the licencing of hydrogen pipeline project (Part 3), new technologies including low carbon heat schemes and hydrogen grid conversion trials (Part 4), the functions of the  Independent System Operator And Planner (Part 5), governance of gas and electricity industry codes (Part 6), market reform and consumer protection (Part 7), heat networks (Part 8), energy smart appliances and load control (Part 9), energy performance of premises (Part 10), energy saving schemes (Part  11), core fuel sector resilience (Part 12), offshore wind electricity generation, oil and gas (Part 13) and civil nuclear sites (Part 14).  The Act comprises three hundred and thirty-five sections supported by twenty-two schedules extends for four hundred and ninety-three pages.

Coming into force. On 27th October. In Chapter 1 of Part 2—sections 56; 57 and 58, (relating to hydrogen production revenue support contracts and a hydrogen production counterparty; sections 65 and 66; section 81(1) to (3), so far as relating to a designation under section 65; section 83 (relating to hydrogen production revenue support contracts and a hydrogen production counterparty); sections 85 and 88 and section 129. Chapter 1 of Part 4; sections 154, 157 to 159. Part 5— sections 169 and 170; section 174 (including Schedule 9), section 175, section 178(2) and sections 180 and 181 section 203 (including Schedule 15), section 204 (including Schedule 16), section 215, Part 8, Part 11 (except sections 264 and 265) sections 307, 308 and 309 and Part 14 – Chapters 3 and 4 of Part 14.

A 2023 c.50 The Online Safety Act 2023

A 2023 c.50. Online Safety Act 2023. Comes into force 26th December. This Act contains provision about the regulation by OFCOM of certain internet services. Part 3 imposes duties of care on providers of regulated user-to-user services and regulated search services and requires OFCOM to issue codes of practice.  Part 4 covers other duties including user identity verification, reporting of sexual exploitation and abuse, transparency, accountability and freedom of expression, fees, false and threatening communications

SI 2023/1156

SI 2023/1156. The Environmental Permitting (England and Wales) (Amendment) Regulations 2023. Coming into force 1st October.  These Regulations amend Part 2 of Schedule 9 to the Environmental Permitting (England and Wales) Regulations 2016 (SI 2016/1154). The definition of “waste material” has been changed. Therefore, the type of waste material to which the 1,000 tonne threshold for notification applies is will now include waste material of a single type, rather than only material of two or more kinds mixed together. The amendments also cover arrangements for sampling waste and record keeping associated with such sampling. Records must now be kept for seven years, up from four.
