SI 2023/1099

SI 2023/1099.   The Misuse of Drugs (England and Wales and Scotland) (Amendment) Regulations 2023.  Comes into force 8th November. Amends the Misuse of Drugs Regulations 2001 (SI 2001/3998) to place nitrous oxide, and preparations or products containing nitrous oxide, in Schedule 5 and to make provision for lawful access to the substance for legitimate purposes, including medical use.

WSI 2023/1096.   The Environment (Wales) Act 2016 (Commencement No. 4) Order 2023. Comes into force on 18th October.  Sections 65 (requirements relating to separate collection etc. of waste), 67 (power to prohibit or regulate disposal of waste by incineration), 68 (civil sanctions), section 69(5) (regulations) and section 70 (minor and consequential amendments and repeals). Comes into force 6th April 2024. Section 66 (prohibition on disposal of food waste to sewer)

EU 2023/2055

EU 2023/2055.  Commission Regulation (EU) 2023/2055 amending Annex XVII to Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) as regards synthetic polymer microparticles.  Comes into force 25th September. The amendment adds Category 78) Synthetic polymer microparticles, with certain exclusions, which are solid and fulfil designated conditions shall not be placed on the market as substances on their own or in mixtures in a concentration equal to or greater than 0,01 % by weight. The amendment also adds test regimes for the degradability and solubility of polymers.

MCA consultation to reduce pollution from ships

The Maritime and Coastguard Agency is consulting on amendments to the Merchant Shipping (Prevention of Pollution by Garbage from Ships) Regulations 2020 and the Merchant Shipping (Prevention of Pollution by Sewage from Ships) Regulations 2020.  Consultation published on 16th October and closes 13th November.  https://www.gov.uk/government/consultations/consultation-on-amendments-to-the-merchant-shipping-prevention-of-pollution-by-garbage-from-ships-regulations-2020-and-the-merchant-shipping-preven    The amendment will expand the category of ships that are required to carry a Garbage Record Book to include every ship of 100 GT and above.
