A 2023 c.28.  Retained EU Law (Revocation and Reform) Act 2023.  This Act passed into law on 29th June.  The Act lists some six hundred items of subordinate legislation and retained direct EU legislation, shown in Schedule 1. which are to be revoked or “sun setted” by 31st December 2023. An explanation of the Act is provided in https://publications.parliament.uk/pa/bills/cbill/58-03/0156/en/220156en.pdf.  EU-derived subordinate legislation is EU legislation enacted on to the UK Statute Book by way of secondary legislation only (e.g. a Statutory Instrument) and not by an Act of Parliament.  Retained direct EU legislation includes regulations, decisions, and tertiary EU legislation. This term does not extend to UK legislation derived from EU treaties or directives.

SI 2023/729

SI 2023/729. The Persistent Organic Pollutants (Amendment) Regulations 2023.  Comes into force 4th July. These regulations amend Regulation (EU) 2019/1021 to extend exemption in Annex 1 applicable to perfluorooctanoic acid (PFOA), its salts and related compounds for certain types of PPE to 3rd December 2025.

SI 2023/722

SI 2023/722. The REACH (Amendment) Regulations 2023. Comes into force 19th July.  These Regulations amend Articles 41 and 127P of The REACH Regulation (EU 2006/1907) by extending cut off dates for registration dossiers selected by the Agency for compliance checking.

Consultation on hedgerow protection

The Department for Environment, Food and Rural Affairs is consulting on protecting hedgerows. Consultation published 28th June and closes 20th September. https://consult.defra.gov.uk/legal-standards/consultation-on-protecting-hedgerows/ This consultation seeks views on the best way to maintain and improve existing protections, as the EU’s land-based subsidies are replaced by new farming schemes and where to focus future hedgerow protection policies.
