Leicestershire Quarry company fined £1,275,000

A Leicestershire Quarry company has been fined £1,275,000 after a contractor was crushed to death during maintenance work. A Health and Safety Executive (HSE) investigation into this incident found that the company had failed to ensure that the powers supply had been properly isolated before the repair work commenced. The test button on the conveyor electrical panel was not connected to the test circuit and was therefore inoperative. This issue appears to have existed for many years before the incident suggesting that critical defects had not been recorded and rectified in a timely manner. The company should have also provided a visual and audible pre-start alarm for the conveyor.

EA consultation on waste charges

The Environment Agency is consulting on charge proposals for notified international waste shipments. Consultation published 4th October and closes 29th November. SI 2023/1046 and /1045

SI 2023/1046. The Environmental Permitting (England and Wales) (Amendment) (England) (No. 2) Regulations 2023. Comes into force 1st December.  These Regulations amend Schedule 26A of Environmental Permitting (England and Wales) Regulations 2016 (SI 2016/1154), with respect to non-compliance penalties.

SI 2023/1045. The Environmental Civil Sanctions (England) (Amendment) Order 2023.  Comes into force 1st December.  This Order amends the Environmental Civil Sanctions (England) Order 2010 (SI 2010/1157) by removing the cap of £250,000 on variable monetary penalties which may be imposed by the Environment Agency or Natural England.

SI 2023/1052. The Building (Restricted Activities and Functions) (England) Regulations 2023. Comes into force 6th April 2024. These Regulations provide a list of the activities and functions of local authorities, the building safety regulator (the Health and Safety Executive) and registered building control approvers which are restricted under sections 46A and 54B of the Building Act 1984 (c. 55)
