April 2023 newsletter

In our April newsletter we bring to your attention one new piece of UK legislation on high-risk buildings, two new RoI SIs on industrial emissions and ballast water and one new EU Regulation on standby energy consumption.   There is a UK commencement (No6) for The Environment Act 2021.  Consultations were raised during the month on EALs, hydrogen production, environmental civil sanctions, national air quality and regulation of offshore hydrogen facilities. HSE has produced revised guidance on violence in the work place. We list six prosecutions of note.

 

We recently received a query about restrictions on the use of diisocyanates.  These substances are mainly used to make polyurethane products, such as rigid and flexible foams, coatings, adhesives, sealants and elastomers.  Commission Regulation (EU) 2020/1149 of 3 August 2020 amended Annex XVII to Regulation (EC) No 1907/2006 (REACH) with respect to diisocyanates.  This amendment states that:

Diisocyanates shall not be used as substances on their own, as a constituent in other substances or in mixtures for industrial and professional use(s) after 24 August 2023, unless:

(a)the concentration of diisocyanates individually and in combination is less than 0.1 % by weight, or

(b)the employer or self-employed ensures that industrial or professional user(s) have successfully completed training on the safe use of diisocyanates prior to the use of the substance(s) or mixture(s).

In our May newsletter we bring to your attention one new Statutory Instrument concerned with building safety, one new EU Regulation concerned with general product safety and amendments to UK, Scottish and Republic of Ireland legislation (two).  HMRC are consulting on amendments to tax on plastic packaging.  There are items of news from the Environment Agency – Low Risk Waste Positions, The Medicines and Healthcare Products Regulatory Agency – extension of  CE Markings to July 2025 and HSE – high concentrations of hydrogen sulphide (H2S) in ullage spaces of cargo and slop tanks.

Simplifi June 2023 newsletter

In our June newsletter we bring to your attention a new item of UK legislation concerning fire protection on merchant shipping and a new item of Republic of Ireland legislation concerning watch keeping on merchant shipping.  There are also amendments to four UK Statutory Instruments; plastic packaging, medical devices, environmental permitting and restriction on hazardous substances. There are amendments to a Republic of Ireland SI on the carriage of dangerous goods and to an EU regulation on dangerous substances. We note consultations on the use of nitrous oxide and future role of the Industrial Energy Transformation Fund.  There are three items which have been “in the news” recently.  Finally, we have two prosecutions of note.

In our July newsletter we bring to your attention a new Act of Parliament concerning retained EU law and two new Statutory Instruments on the administration of nuclear licences and, for Wales, data for waste packaging. During the month amendments were made to eleven Statutory Instruments; waste packaging (England), REACH, persistent organic pollutants, planning, cosmetic products (twice), environmental offences, explosives precursors and poisons, goods vehicle licencing and greenhouse gas emission trading.  For the Republic of Ireland there are two new regulations concerned with the safety of merchant shipping.   For the EU there is an amendment to a regulation   on plastic materials and articles intended to come into contact with food.

We note current consultations on navigation safety risk of aquaculture sites, the protection of hedgerows, the adoption of a mass balance approach for chemically recycled plastic and proposals aimed at increasing employer use of occupational health services. HSE has released work-related fatality figures for the year 2022/23. HSE has also announced that they are changing some of the processes associated with the Ionising Radiations Regulations 2017. Finally, there are two prosecutions of note.
