 Dear Simplifi User,

We recently had a query asking if there was specific legislation with respect to the control of Legionella in the work place.  The answer is NO, but..

As for any substance hazardous to health Sections 3.2 and 3.3 of The Health and Safety at Work Act 1974 apply. Section 2(1) imposes a duty on employers to ensure, as far as reasonably practicable, the health, safety and welfare at work of all his employees.  Section 2(2)(d) requires places of work under the control of an employer to be maintained in a state which is safe and not a risk to health.   Section 3 (1) requires employers to conduct their undertakings in such a way that persons who are not employees but who may be affected thereby are not exposed to risks to their health or safety.

In addition, SI 2002/2677 The Control of Substances Hazardous to Health Regulations 2002 (COSHH) provides a framework of actions to control the risk from a range of hazardous substances, including biological agents (eg Legionella) – to identify and assess the risk, and implement any necessary measures to control any risk.

The COSHH Regulations are supported by an Approved Code of Practice (ACOP) for the Control of Legionella (L8) which is available in the Guidance section of the Simplifi website or at http://www.hse.gov.uk/pUbns/priced/l8.pdf.

This legislation also applied to landlords, as under Section 53 of HSWA they are regarded as being self-employed and tenants fall into the class of “other persons (not being his employees)”.

Key to the demonstration of compliance is the maintenance of good records which must include a risk assessment, a control plan, with system drawings, and the results of monitoring and routine inspections.

Amending legislation

Energy

 SI 2018/980.  The Scotland Act 2016, Wales Act 2017 and Onshore Petroleum (Consequential, Transitional and Saving Provisions and Model Clauses) Regulations 2018.  Comes into force 1st October.  These Regulations make amendments to the regime for the licensing of petroleum which has been devolved to the Welsh Assembly for the granting and regulation of licences to search and bore for and get petroleum within the “Welsh onshore area”.  They also make similar amendments with respect of petroleum licensing within the “Scottish onshore area”.

Quality

 SI 2018/995.  The Copyright and Related Rights (Marrakesh Treaty etc.) (Amendment) Regulations 2018.  Comes into force 11th October. These Regulations amend both the Copyright, Designs and Patents Act 1988 (A 1988 c.48) and the Copyright and Rights in Database Regulations 1997 (SI 1997/3032).  These Regulations amend how the exception permitted under the Infosoc Directive, and required under the Directive, is implemented in the UK.

Plant protection.

SSI 2018/ 283. The Plant Health (Scotland) Amendment (No. 2) Order 2018.  Comes into force 17th November.  Amends The Plant Health (Scotland) Order 2005 (SSI 2005/613). It implements Commission Implementing Decision 2018/490 repealing Decision 2007/365/EC on emergency measures to prevent the introduction into and spread within the Community of Rhynchophorus ferrugineus (Olivier).

 Work equipment

SI 2018/1004. The Vehicle Drivers (Certificates of Professional Competence) (Amendment) (EU Exit) Regulations 2018.  Comes into force on Brexit day.    These Regulations amend SI 2007/605 The Vehicle Drivers (Certificates of Professional Competence) Regulations 2007.  The Regulations ensure that following the withdrawal of the United Kingdom from the European Union, the domestic system regarding certificates of professional competence continues to operate effectively.

 SR 2018/966. The Simple Pressure Vessels, Electrical Equipment and Pressure Equipment (Miscellaneous Amendments) (Northern Ireland) Regulations 2018.  Comes into force 1st October. These Regulations amend, with respect to Northern Ireland, the Simple Pressure Vessels (Safety) Regulations 2016 (SI 2016/1092), the Electrical Equipment (Safety) Regulations 2016 (SI 2016/1101), and the Pressure Equipment (Safety) Regulations 2016 (SI 2016/1105).  The amendments have the effect of aligning provisions relating to enforcement by the Health and Safety Executive for Northern Ireland with those for enforcement by the Health and Safety Executive in relation to the rest of the United Kingdom.

Eire legislation

RI 2018/296. European Union (Planning and Development) (Environmental Impact Assessment) Regulations 2018. Comes into force 1st September.  These Regulations transpose into Irish law the provisions of Directive 2014/52/EU on the assessment of the effects of certain public and private projects on the environment by amending the Planning and Development Act 2000, the Planning and Development (Housing) and Residential Tenancies Act 2016, the Planning and Development (Amendment) Act 2018 and the Planning and Development Regulations 2001.

 

Consultations

 The Marine and Coast Guard Agency is consulting on changes to the Merchant Shipping (Safety of Navigation) Regulations.  Consultation closes 19th November.  The change is to bring up to date the UK’s transposition of Chapter V (Safety of Navigation) of the International Maritime Organization’s (IMO) International Convention for the Safety of Life at Sea 1974 (SOLAS). In the News.

 The third edition of EH40/2005 has just been published (August 2018). This latest version of EH40 has been updated to include new and revised workplace exposure limits (WELs) introduced by the 4th Indicative Occupational Exposure Limit Values (IOELV) Directive.  A copy has been posted in the guidance section. http://www.hse.gov.uk/pubns/priced/eh40.pdf

A £3,000,000 support scheme launched to reduce air pollution from farming.  Farming is responsible for eight-eight percent of all UK emissions of ammonia gas which can travel long distances, be damaging to the environment, and combine with other pollutants to form particulates, which are harmful to human health.  The Catchment Sensitive Farming partnership between Defra, the Environment Agency and Natural England will support farmers to reduce these emissions.  https://www.gov.uk/government/news/3m-support-scheme-launched-to-reduce-air-pollution-from-farming

Dear Simplifi User,

November is Movember when “brave and selfless men around the world grow a moustache, and women step up to support them, to raise awareness and funds for men’s health – specifically prostate and testicular cancer”.  Now, not wanting to put a dampener on such enlightened activity, we thought we should consider if there might be implications resulting from the new growth of facial hair with respect to health and safety?

The Health and Safety at Work Act and the Management of Health and Safety at Work Regulations require employers to provide and maintain, so far as is reasonably practicable, a safe working environment.  Regulation 9 of the COSHH Regulations covers the maintenance, examination and testing of control measures, which include respiratory protective equipment (RPE).

HSG53 Respiratory Protective Equipment at Work, A practical Guide provides further information, including the carrying out of a face fit test.  HSE comment that facial hair may make it impossible to get a good seal of a mask to the face.

So, while growth to support Movember is to be applauded there are aspects which may require further consideration.  It may be necessary for growers to wear alternative forms of RPE which do not rely on a tight fit to the face.

New legislation

Radiation and Radioactive substances.

 SI 2018/1094. The Special Fissile Materials (Right of Use and Consumption) (EU Exit) Regulations 2018.  Comes into force on Brexit day.  These Regulations end the unlimited right of use and consumption of special fissile materials, granted under Article 87 of the Euratom Treaty, as the collective ownership of special fissile materials, under Article 86 of the Treaty, will cease to be effective on the date the UK withdraws from the Treaty.

 

Amending legislation

Noise.

SI 2018/1089. The Environmental Noise (England) (Amendment) Regulations 2018. Comes into force 31st December.  These Regulations amend the Environmental Noise (England) Regulations 2006 (SI 2006/2238) to implement Commission Directive (EU) 2015/996 establishing common noise assessment methods according to Directive 2002/49/EC.

 

Plant protection.

SI 2018/1025. The Timber and Timber Products and FLEGT (EU Exit) Regulations 2018.  Comes into force on Brexit day. These Regulations are made in exercise of the powers in section 8(1) of the European Union (Withdrawal) Act 2018.  These Regulations make amendments to SI 2012/178 The Forest Law Enforcement, Governance and Trade Regulations 2012 and SI 2013/233 The Timber and Timber Products (Placing on the Market) Regulations 2013 to minimise the risk of placing illegally harvested timber and timber products derived from such timber on the market.

SI 2018/1048.  The Plant Health (Forestry) (Amendment) (England and Scotland) Order 2018.  Comes into force 1st November. This Order amends the Plant Health (Forestry) Order 2005 (S.I. 2005/2517) to (a)implement Commission Implementing Decision (EU) 2017/2352 amending Implementing Decision (EU) 2015/789 as regards measures to prevent the introduction into and spread within the Union of Xylella fastidiosa (Wells et al.) (b)introduce emergency measures to prevent the introduction of Thaumetopoea processiona L. (the Oak Processionary Moth) into the area in England and Scotland which is recognised as a protected zone for this harmful plant pest; (c)amend various references to EU instruments that are out of date.

SI 2018/1051.   The Plant Health (England) (Amendment) (No. 4) Order 2018.  Comes into force 1st November.   This Order amends the Plant Health (England) Order 2015 (SI 2015/610) to implement Commission Implementing Decision (EU) 2018/638 establishing emergency measures to prevent the introduction into and the spread within the Union of the harmful organism Spodoptera frugiperda (Smith).  It also removes provisions in SI 2015/610 which implement various EU instruments which are no longer in force.

Waste

SR 2018/171. The Ship Recycling Facilities (Amendment) Regulations (Northern Ireland) 2018. Comes into force 29th October.  This regulation amends the definition of the “European List” in SR 2015/229. The Ship Recycling Facilities Regulations (Northern Ireland) 2015.

 

Commencement

 Radiation and Radioactive substances.

SI 2018/1079. The Nuclear Safeguards Act 2018 (Commencement No. 1) Regulations 2018.  The following provisions of the Nuclear Safeguards Act 2018 come into force on 26th October 2018— (a)section 1(2) to 1(4);(b)paragraphs 1, 3, 5, 9, 10 and 13 of the Schedule and section 1(5) in so far as it relates to those paragraphs;(c)section 2; and (d)section 4.

 

Consultations

The Marine and Coastguard Agency is consulting on revisions to MGN 570 Emergency Drills and MGN 571 Prevention of Man Overboard.  Consultation closes 31st October.

These MGNs are being updated to reflect the implementation of the ILO Work in Fishing Convention C.188 and the future publication of MGN 588 – Compulsory Provision and Wearing of Personal Floatation Devices on Fishing Vessels. DEFRA is consulting on three draft Noise Action Plans covering roads, railways and agglomerations (large urban areas). Consultation closes 15th November.  This consultation is on the third round of noise action plans which will replace those previously adopted. The action plans have been prepared in line with the terms of the Environmental Noise Directive (END), which requires Member States to produce noise maps every five years. They chart the level of noise from industry and transport sources, and the number of people exposed to it. Prosecutions of note.

A Bedfordshire waste company has been fined £100,000 and ordered to pay costs of £11,603 after two of its employees suffered burns whilst using an industrial plastic shredder to process flammable aerosol containers. While using a gas operated forklift to lift the canisters into a shredder, a spark from the forklift ignited a cloud of gas created by the shredded aerosols, leading to an explosion. Recently we have had a couple of queries about legislation which has been revoked and replaced by new legislation in England (and possibly Wales) but is still valid in other parts of the United Kingdom.  One example is The Special Waste Regulations 1996 (SI 1996/972) which was, for England and Wales, revoked and replaced by The Hazardous Waste (England and Wales) Regulations 2005 (SI 2005/894), but is still valid in Scotland.  Another example is The Fire Precautions (Sub-surface Railway Stations) Regulations 1989 (SI 1989/1401), which for England only, have been revoked and replaced by SI 2009/782 Fire Precautions (Sub-surface Railway Stations) (England) Regulations 2009.

Simplifi will always highlight cases where legislation has been partially revoked in the “brief commentary” section for the legislation but will not show the legislation as revoked.

New legislation

Climate change

SI 2018/1205. The Climate Change Agreements (Amendment of Agreements) (EU Exit) Regulations 2018. Comes into force on Brexit day.  These Regulations make amendments to the umbrella and underlying agreements, which exist under the Climate Change Agreement Scheme established under Schedule 6 to the Finance Act 2000 (c.17).

 

Energy and renewables.

 SI 2018/1183.  The Electricity and Gas (Energy Company Obligation) Order 2018. Comes into force 7th December. These Regulations establish the Energy Company Obligation scheme for the period to 31st March 2022 for the promotion of measures for reducing the cost to individuals of heating their homes.

 

Merchant Shipping

 SI 2018/1106. The Merchant Shipping (Work in Fishing Convention) Regulations 2018. Comes into force 31st December.  These Regulations implement parts of the Work in Fishing Convention, 2007 (Cm 7375). They apply to United Kingdom fishing vessels wherever they may be and to fishing vessels in United Kingdom waters. They set a minimum age for working as a fisherman, work agreements and payments, repatriation, accommodation, food and medical care. They cover inspection of fishing vessels.  They also revoke and replace The Merchant Shipping (Provisions and Water) Regulations 1989 (SI 1989/102).

 SI 2018/1107. The Merchant Shipping (Work in Fishing Convention) (Survey and Certification) Regulations 2018. Comes into force on 30th November with the exception of regulations 7 and 9 to 14 come into force on 30th November 2019. These Regulations implement Articles 41 to 43 of the Work in Fishing Convention, 2006 (Cm 7375). They apply to United Kingdom fishing vessels wherever they may be and to other fishing vessels in United Kingdom waters. They cover survey of fishing vessels, the issuing of a Work in Fishing Convention Certificate and the requirement to carry such a certificate on board the vessel in question.

 SI 2018/1108.  The Merchant Shipping (Work in Fishing Convention) (Medical Certification) Regulations 2018.  Comes into force on 30th November. These Regulations cover the requirement for fishermen to possess medical fitness certificates and carry them on board the fishing vessel on which they are working. The also cover the issuing of such certificates and the requirement for fishermen to self-report medical conditions to a doctor.

SI 2018/1109. The Merchant Shipping (Work in Fishing Convention) (Consequential Provisions) Regulations 2018. Comes into force on 31st December with the exception of regulation 3 which comes into force on 30th November 2019. These Regulations make consequential amendments to Merchant Shipping Act 1995, SI1972/919; Merchant Shipping (Crew Agreements, Lists of Crew and Discharge of Seamen)(Fishing Vessels) Regulations 1972, SI 1972/1698; Merchant Shipping (Seamen’s Allotments) Regulations 1972, SI 1972/1701; Merchant Shipping (Seamen’s Wages and Accounts) Regulations 1972, SI 1979/97; Merchant Shipping (Repatriation) Regulations 1979, SI 1997/2962; Merchant Shipping and Fishing Vessels (Health and Safety at Work Regulations 1997 and SI 2004/1713; Fishing Vessels (Working Time: Sea-fishermen) Regulations 2004.

 

Plant Health, Biocides and Food.

SR 2018/184. The Plant Health Order (Northern Ireland) 2018. Comes into force 1st December. This Order revokes and consolidates with amendments the Plant Health Order (Northern Ireland) 2006 (SR 2006/82) and replaces the Plant Health (Phytophthora ramorum) Order (Northern Ireland) 2005 (SR. 2005/23).

 

Waste

 SI 2018/1122.  The Ship Recycling (Requirements in relation to Hazardous Materials on Ships) (Amendment etc.) Regulations 2018. Coming into force 31st December.  These Regulations bring into UK law parts of the EU Regulation on ship recycling (EU 2013/1257) which cover requirements which to the construction of a ship, the ship during its working life and its preparation for recycling.

  

Amending legislation

Energy and renewables.

 SSI 2018/352.  The Renewables Obligation (Scotland) Amendment Order 2018. Comes into force 20th November. These Regulations amend Renewables Obligation (Scotland) Order 2009 (SSI 2009/140).   This Order lifts a restriction on the amount of electricity which can be produced by hydro generating stations without affecting eligibility for Scottish Renewable Obligation Certificates (SROCs).

 

 Environmental planning and pollution

 SI 2018/1227. The Environmental Protection (Miscellaneous Amendments) (England and Wales) Regulations 2018.  Comes into force 7th January 2019.  These Regulations make amendments to the Environmental Protection Act 1990 (c. 43) and the Environmental Permitting (England and Wales) Regulations 2016 (SI 2016/1154).  Amendments to SI 2016/1154 cover new conditions for environmental permits authorising certain waste operations, amendments relating to flood risk activities and an amendment relating to radioactive substances activities.

WSI 2018/1216. The Environment, Planning and Rural Affairs (Miscellaneous Amendments) (Wales) Regulations 2018.  Comes into force 17th December.  These Regulations make amendments in relation to Wales to a number of pieces of secondary legislation relating to the environment, planning and rural affairs.  Most relevant are amendments to the Environmental Damage (Prevention and Remediation) (Wales) Regulations 2009 (WSI 2009/995) and the Water Abstraction (Transitional Provisions) Regulations 2017 (SI 2017/1047).

  

Merchant shipping

 SI 2018/1202. The Merchant Shipping and Fishing Vessels (Health and Safety at Work) (Miscellaneous Amendments) (EU Exit) Regulations 2018. Comes into force on Brexit day.  Makes very minor amendments to:

My we wish you a very happy Christmas and everything of the best in 2019?

We recently received a query about the regulatory regime for underground fuel tanks (USTs). There is no legislation specific to USTs. Schedule 1 of The Environmental Permitting (England and Wales) Regulations 2016; SI 2016/1154 covers activities for which an environmental permit is required in England and Wales. The Water Environment (Controlled Activities) (Scotland) Regulations 2011; SSI 2011/209 covers similar activities in Scotland.  For both pieces of legislation what matters is the type of substance being stored not how it is stored.  So for England and Wales the storage of a hazardous substance listed in Schedule 22 of SI 2016/1154, which has the potential to impact surface or groundwater requires an Environmental Permit.  USTs located on sites which have Environmental Permits will be included in the scope of the Permit.

Other legislation which may be of relevance includes The Planning (Hazardous Substances) Regulations 2015; SI 2015/627 and Control of Major Accident Hazards Regulations 2015; SI 2015/483.

Regulation of above ground storage tanks is covered by The Control of Pollution (Oil Storage) (England) Regulations 2001, SI 2001/2954, The Water Environment (Controlled Activities) (Scotland) Regulations 2011; SSI 2011/ 209, Control of Pollution (Oil Storage) Regulations (Northern Ireland) 2010; SR 2010/254 and The Water Resources (Control of Pollution) (Oil Storage) (Wales) Regulations 2016 (WSI 2016/359)

The Department for Environment, Food and Rural Affairs (Defra) has published codes of practice on how to prevent pollution from petrol, diesel and other fuel tanks.  These are: https://www.gov.uk/guidance/prevent-groundwater-pollution-from-underground-fuel-storage-tanks. Natural Resources Wales (NRW) has published a Code of Practice on protecting groundwater from pollution from USTs https://gov.wales/docs/desh/publications/170323-underground-storage-groundwater-protection-code-en.pdf.  The requirements of the NRW Code of Practice are almost identical to those in the Defra Code of Practice.  For Scotland SEPA has published https://www.sepa.org.uk/media/100570/ppg-27-installation-decommissioning-and-removal-of-underground-storage-tanks.pdf.  Guidance on USTs which was part of the pollution prevention guidelines (PPG27 Installation, Decommissioning and Removal of underground storage tanks) was withdrawn in December 2015.

DEFRA guidance states “By following this code you should avoid having to apply for an environmental permit issued under the Environmental Permitting Regulations. You must still follow existing codes, guidance and laws, like health and safety regulations!

The Climate Change (International Aviation and International Shipping) (Wales) Regulations 2018.  Comes into force 6th December.  These Regulations provide a formula for determining what emissions of greenhouse gases from international aviation and international shipping are to be regarded as Welsh emissions for the Environment (Wales) Act 2016.

SR 2018/200. The Environment (Miscellaneous Amendments) Regulations (Northern Ireland) 2018. Comes into force 24th December. These regulations are made in exercise of the powers in, the European Communities Act 1972 in order to make minor miscellaneous technical amendments to update outdated references in existing legislation that transposes current EU environmental requirements.

 SI 2018/1230. The Building (Amendment) Regulations 2018.  Comes into force on 21st December. These Regulations amend a number of sections of the Building Regulations 2010 (SI 2010/2214).

 SI 2018/1232.  The Environmental Assessments and Miscellaneous Planning (Amendment) (EU Exit) Regulations 2018. Comes into force on Brexit day. These Regulations make amendments to legislation in the field of town and country planning and infrastructure planning.  The legislation in question is:

Amends SI 2015/627 The Planning (Hazardous Substances) Regulations 2015.  These Regulations: replace a number of references to EU Directives to references within the Control of Major Accident Hazards Regulations 2015. (SI 2015/483).
