September news letter

In our September newsletter, we report on one piece of new legislation providing protection of the environment and amendments to legislation on climate change and health protection.  We cover three pieces of legislation from the Republic of Ireland and one from the EU.  We report on progress on The Climate and Ecology Bill 2019-21 and the Fire Safety Bill 2019-21.  The EA are consulting on new guidance for facilities that take non-hazardous and inert waste for treatment or transfer. There are two prosecutions of note.

October news letter

In our October newsletter we report on two new pieces of legislation concerning protection to theenvironment and three on protection of health (COVID-19). We cover amendments to legislation ondangerous goods, planning and waste. We note progress on changes to REACH and on the passageof the Environment and Fire Safety Bills through Parliament. There are two new consultations.

Revocation of the CHIP Regs

Recently Simplifi received a query about the status of the CHIP Regulations (SI 2009/716).  The question was “are any of the CHIP Regulations still valid”?

SI 2009/716 The Chemicals (Hazard Information and Packaging for Supply) Regulations 2009 were revoked by SI 2013/1506 The Biocidal Products and Chemicals (Appointment of Authorities and Enforcement) Regulations 2013.  However, to complicate matters not all the CHIP Regulations were revoked at the same time.  The sequence of revocations was

September 2013 – Regulation 5;June 2015 – Regulations 4, 6, 7, 8, 9,10, 11, 13, 14, 15, 16, 17 and 18June 2018 – Regulation 1, 2, 3 and 12.

So as of June 2018 all of the CHIP Regulations had been revoked.

Conformity marking after 01/01/21

The BREXIT transition period will come to an end on 31st December. From 1st January 2021 UKCA marking will begin to replace CE marking for goods being placed on the UK market. The UKCA Mark may be placed directly on the product or on an accompanying document until 31st December 2022. From 1st January 2023 the UKCA mark must be placed directly on the product. However, the UKCA mark will not be recognised for products being placed on the EU market. https://www.hse.gov.uk/brexit/regulating-equipment.htm
