January 2019 news letter

 Dear Simplifi User,

Questions are often asked at this time of year about what the law says on minimum temperatures in the workplace.  Temperatures in the indoor workplace are covered by the Workplace (Health, Safety and Welfare) Regulations 1992 (SI 1992/3004), which place a legal obligation on employers to provide a ‘reasonable’ temperature in the workplace.  The associated Approved Code of Practice –  http://www.hse.gov.uk/pubns/books/l24.htm – suggests that the minimum temperature in a workplace should normally be at least 16o C. If the work involves rigorous physical effort, the temperature should be at least 13o C.

These temperatures are not absolute legal requirements and an employer has a duty to determine what “reasonable comfort” will be in the particular circumstances. In addition to the Workplace Regulations, the Management of Health and Safety at Work Regulations 1999 (SI 1999/3242) require employers to make a suitable assessment of the risks to the health and safety of their employees, and take action where necessary and where reasonably practicable. The temperature of the workplace is one of the potential hazards that employers should address to meet their legal obligations.

While there is no specific legislation, employers should also consider hazards associated with outdoor work where it occurs.  The impact of adverse weather, not just cold, can impact on an individual’s effectiveness and this may not be readily managed using just engineering controls. Some of the most effective ways of managing these hazards are to introduce some simple administrative controls.  These include:

The provision of appropriate personal protective equipment The provision of facilities for warming up and warm fluids such as soup or hot drinks Scheduling of work and rest breaks Training and awareness on the recognition of the early symptoms of cold stress.

HSE have published guidance to companies which supply or purchase substances, mixtures or articles to and from the EU/EEA and the UK in the case of a “no-deal” Brexit occurring.  They state that in a “no-deal” scenario, the UK and the EU regulatory agencies would operate independently from each other.  They add that in order to maintain or gain access to both markets, companies will need to ensure that the substances, or substances within a mixture or article, are registered separately with both agencies (ECHA and the UK Agency, i.e. the HSE).  http://www.hse.gov.uk/brexit/reach.htm

SI 2019/40. The Plant Health (Ips typographus) (England) Order 2019.  Comes into force 16th January.  This Order introduces specific measures for the control of infestations of Ips typographus (Heer) (the larger eight-toothed spruce bark beetle) which is a serious pest of conifer trees.

 SI 2018/1399. The Marine Environment (Amendment) (EU Exit) Regulations 2018. Comes into force on Brexit day.  Amends legislation in the field of the marine environment and, in particular, marine strategy. Amended legislation is:

The Marine and Coastal Access Act 2009 (c. 23)), The Marine Strategy Regulations 2010 (SI 2010/1627 The Marine Licensing (Exempted Activities) Order 2011 (SI 2011/409)).

SI 2019/35. The Renewables Obligation (Amendment) (EU Exit) Regulations 2019. Comes into force on Brexit day.  These Regulations make amendments to

SI 2019/25. SI 2019/39. The Environmental Permitting (England and Wales) (Amendment) (EU Exit) Regulations 2019. Comes into force on Brexit day.  These Regulations make amendments to the Environmental Permitting (England and Wales) Regulations 2016 (SI 2016/1154). The amendment adds a new Schedule 1A which details modifications to EU Directives and their application.  Directives modified are:

SI  2019/90.  The Genetically Modified Organisms (Amendment) (EU Exit) Regulations 2019. Comes into force on Brexit day.  These Regulations amend the Genetically Modified Organisms (Risk Assessment) (Records and Exemptions) Regulations 1996 (SI 1996/1106) to redress provisions in that Regulation which are out of date, specifically relating to devolution issues in risk assessment and record-keeping.

SR 2018/188. The Pesticides, Genetically Modified Organisms and Fertilisers (Miscellaneous Amendments) Regulations (Northern Ireland) 2018. Comes into force 7th January. The Regulations make miscellaneous minor amendments to legislation relating to pesticides, fertilisers, seed marketing, nitrates and genetically modified organisms, updating out of date references. February’s news letter is filled with amendments made to legislation “to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union”.

New legislation

Environmental permitting and pollution.

SI 2019/42.  The Merchant Shipping (Prevention of Oil Pollution) Regulations 2019.  Comes into force 1st March.  These Regulations replace and revoke the Merchant Shipping (Prevention of Oil Pollution) Regulations 1996 (SI 1996/2154). These Regulations implement Annex I (Regulations for the Prevention of Pollution by Oil) of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978.

 

Radiation and radioactive substances

SI 2019/156.   The Transfrontier Shipment of Radioactive Waste and Spent Fuel (EU Exit) Regulations 2019. Comes into force on Brexit day.  These Regulations revoke and replace the Transfrontier Shipment of Radioactive Waste and Spent Fuel Regulations 2008 (SI 2008/3087). These Regulations largely replicate the key provisions and penalties contained SI 2008/3087 in the United Kingdom but, in light of the United Kingdom’s withdrawal from the European Union, they abolish the distinction between Member States and third countries. That means that all countries outside the United Kingdom will be treated as third countries and there is no longer any provision for the mutual recognition of authorisations. These Regulations also largely replicate the key procedural provisions contained in Council Directive 2006/117/Euratom in order to provide the maximum continuity for operators in this sector. The standard forms referred to in Regulation 9 will be found on the Gov.UK website.

SI 2019/195. The Nuclear Safeguards (Fissionable Material and Relevant International Agreements) (EU Exit) Regulations 2019. Comes into force on Brexit day.  After Brexit day nuclear safeguards in the United Kingdom, will no longer be regulated by the EURATOM treaty.  These Regulations define Fissionable Material and list the relevant international agreements for the purposes of section 112(1A) of the Energy Act 2013.

 SI 2019/196. The Nuclear Safeguards (EU Exit) Regulations 2019.  Comes into force on Brexit day.  After Brexit day nuclear safeguards in the United Kingdom, will no longer be regulated by the EURATOM treaty. These Regulations set out the United Kingdom regime for nuclear safeguards in civil activities.

  

Amending legislation

 Environmental permitting and pollution.

 SI 2019/96.  The Control of Mercury (Amendment) (EU Exit) Regulations 2019.  Comes into force on Brexit day. These Regulations amend The Control of Mercury (Enforcement) Regulations 2017 (SI 2017/1200).  The amendments are to omit Regulation 6 and make a very slight changes to Regulation 38.

SI 2019/107.  The Greenhouse Gas Emissions Trading Scheme (Amendment) (EU Exit) Regulations 2019. Comes into force on Brexit day. These Regulations amend amendments to the Greenhouse Gas Emissions Trading Scheme Regulations 2012 (SI 2012/3038).    The functioning of the EU Emissions Trading Scheme depends on the monitoring and reporting of emissions by participants for each scheme year. It also requires the surrender by participants of a corresponding number of allowances in relation to their emissions for each scheme year. The issuing and surrender of allowances is dependent on EU systems and infrastructure, as such that aspect of the scheme will cease to apply to UK operators after the 2018 Scheme year in a no deal scenario. The monitoring, reporting, accreditation and verification obligations will continue to apply.

SI 2019/131. The Marketing of Seeds and Plant Propagating Material (Amendment) (England and Wales) (EU Exit) Regulations 2019. Comes into force on Brexit day. Makes amendments to:

New legislation

Radiation and radioactive substances

SI 2019/571.  The Shipments of Radioactive Substances (EU Exit) Regulations 2019.  Comes into force on Brexit day.  These Regulations revoke Council Regulation (Euratom) 1493/93. Following that revocation the Regulations provide for a similar regime in relation to the import of sealed sources into the UK from European Union Member States.

 Amending legislation

 Dangerous goods.

SI 2019/598. The Carriage of Dangerous Goods (Amendment) Regulations 2019. Comes into force 22nd April. These Regulations amend regulation 3 of the Transfrontier Shipment of Radioactive Waste and Spent Fuel Regulations 2008 in order to update the reference to Council Directive 96/29/Euratom laying down basic standards for the protection of the health of workers and the general public against the dangers arising from ionizing radiation.  They also amend the Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009 in order to implement in provisions of Council Directive 2013/59/Euratom laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation.

 Energy

 SI 2019/421. The Alternative Fuel Labelling and Greenhouse Gas Emissions (Miscellaneous Amendments) Regulations 2019. Regulations come into force over the period 22nd March to 1st September. Parts 1 to 3 of this instrument implement requirements of EU Directive 2014/94/EU on the deployment of alternative fuels infrastructure on the standardisation of labelling of types of motor vehicle fuel.  Part 2 requires fuel retailers to label refuelling points in order to provide clear information to users about the alternative fuel they dispense.  Part 4 amends the Motor Fuel (Road Vehicle and Mobile Machinery) Greenhouse Gas Emissions Reporting Regulations 2012 (S.I 2012/3030). The amendment allows certain energy suppliers to claim GHG credits arising out of reductions in upstream emissions generated in 2019.

SI 2019/528. The Greenhouse Gas Emissions Trading Scheme (Amendment) Regulations 2019.  Comes into force 26th March.  Amends The Greenhouse Gas Emissions Trading Scheme Regulations 2012 by substituting 26th March 2019 for the 15th of March 2019 in three places.

SI 2019/530. The Electricity and Gas etc. (Amendment etc.) (EU Exit) Regulations 2019. Comes into force on Brexit day. Amends:

Also makes amendments to retained direct EU legislation; Regulation (EC) No 1005/2009 and Regulation (EU) No 517/2014.

SI 2019/644. The Greenhouse Gas Emissions Trading Scheme (Amendment) (No. 2) Regulations 2019. Comes into force 29th March. These regulations amend the Greenhouse Gas Emissions Trading Scheme Regulations 2012.  The amendments cover interpretations and changes the deadline for aircraft operators to surrender sufficient allowances to cover their annual reportable emissions for the 2018 scheme year.

WSI 2019/460. The Flood and Water (Amendments) (England and Wales) (EU Exit) Regulations 2019. Comes into force on Brexit day. Amends:

Merchant shipping

SI 2019/470.  The Merchant Shipping (Marine Equipment) (Amendment etc.) (EU Exit) Regulations 2019. Comes into force on Brexit day. Amends Merchant Shipping (Marine Equipment) Regulations 2016 (SI 2016/1025). This instrument establishes a United Kingdom conformity assessment procedure for marine equipment placed or to be placed on board a United Kingdom ship. It provides for the application of international standards for equipment placed on United Kingdom ships and for the enforcement of those standards. This is achieved by requiring marine equipment to comply with the international design, construction and performance standards contained in the International Maritime Organisation (“IMO”) International Conventions, and that equipment be approved as such by a United Kingdom approved body. Again we have seen many amendments to UK Regulations for EU Exit.  Many of these amendments concern product accreditation, so changes from the EU to UK Assessment Bodies and from EU to UK “kite marks”.  In effect the UK has now put in place a system which duplicates that developed by the EU.

In addition to providing a register of legislation Simplifi maintain a database of information providing guidance.   This guidance covers Approved Codes of Practice published by the HSE (Legal Reference Documents (the L Series) and Health and Safety Guidance (HSG) publications). We also cover Guidance For Pollution Prevention (including the most recent GPP 29 Micro-breweries and distilleries, March 2019), EU Directives, BAT, chemicals and dangerous substances (including REACH), energy, environmental permitting and pollution, waste and water.

 

New legislation

Plant health

 SI 2019/787.  The Plant Health (EU Exit) Regulations 2019. Comes into force on Brexit day.  This Regulation defines the relevant UK authorities responsible for plant health, lists, for the maintenance of plant health, regulated plant pests and relevant material and specifies the measures to be taken in the case of an emergency.  The regulation also revokes retained EU Regulations.

 Radiation and radioactive substances

 SI 2019/703.  The Radiation (Emergency Preparedness and Public Information) Regulations 2019.  Comes into force 22nd May.  These Regulations revoke and supersede the Radiation (Emergency Preparedness and Public Information) Regulations 2001. The Regulations impose duties on operators of premises in which work with ionising radiation takes place to identify the hazards arising from the work with such radiation which have the potential to cause a radiation emergency. Where such hazards exist, the operator is under a duty to assess the consequences of the radiation emergency, and liaise with the local authority. Both the local authority and the operator must engage in planning against the radiation emergency occurring, test such plans at regular intervals and provide information to the public. The Regulations implement in part as respects Great Britain provisions of Council Directive 2013/59/Euratom of 5 December 2013 laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation.

 SI 2019/720.  The Chemicals (Health and Safety) and Genetically Modified Organisms (Contained Use) (Amendment etc.) (EU Exit) Regulations 2019.  Comes into force on Brexit day.  Makes very minor textual amendments (replacing changing the words “laid down” to “as provided for” in the definition of “hazardous substance or mixture”, in:

the Health and Safety (Enforcing Authority) Regulations 1998; the Health and Safety (Enforcing Authority) Regulations (Northern Ireland) 1999; the Control of Substances Hazardous to Health Regulations 2002; the Dangerous Substances and Explosive Atmospheres Regulations 2002; the Control of Substances Hazardous to Health Regulations (Northern Ireland) 2003; the Dangerous Substances and Explosive Atmospheres Regulations (Northern Ireland) 2003;

SI 2019/758.   The REACH etc. (Amendment etc.) (EU Exit) Regulations 2019. Comes into force on Brexit day.  These Regulations make amendments to Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH).  Energy

 SR 2019/76   The Energy Performance of Buildings (Certificates and Inspections) (Amendment) Regulations (Northern Ireland) 2019.  Comes into force 30th April.   These Regulations amend the Energy Performance of Buildings (Certificates and Inspections) Regulations (Northern Ireland) 2008, by adding a new regulation 25A to set the fees for entering data onto the register of: energy performance certificates, display energy certificates and air conditioning inspection reports.

 SI 2019/648.  The Road Vehicles and Non-Road Mobile Machinery (Type-Approval) (Amendment) (EU Exit) Regulations 2019. Comes into force on Brexit day. Amends:

 SI 2019/672. The Detergents (Amendment) (EU Exit) Regulations 2019.  Comes into force on Brexit day. Amends the Detergents Regulations 2010 and Regulation (EC) No 648/2004 of the European Parliament and of the Council on detergents.

SI 2019/778. The Environment, Food and Rural Affairs (Amendment) (EU Exit) Regulations 2019.  Comes into force on Brexit day. Amends the Natural Mineral Water, Spring Water and Bottled Drinking Water (England) Regulations 2007 and certain retained direct EU legislation relating to food and drink.

WSI 2019/863.   The Nitrate Pollution Prevention (Wales) (Amendment) Regulations 2019. Comes into force 1st May. These Regulations amend the Nitrate Pollution Prevention (Wales) Regulations 2013 (SI 2013/2506) relating to monitoring of nitrate pollution and designation of nitrate vulnerable zones
