New legislation

Environmental permitting and pollution

 SSI 2017/322. The Pollution Prevention and Control (Designation of Medium Combustion Plant Directive) (Scotland) Order 2017.  Comes into force 1st November.  This Order designates Directive 2015/215/EU of the European Parliament and of the Council on the limitation of certain pollutants into the air from Medium Combustion Plants as a relevant directive for the purposes of paragraph 20 of Schedule 1 to the Pollution Prevention and Control Act 1999.

 Offshore

 SI 2017/943. The Fishing Vessels (Codes of Practice) Regulations 2017.  Coming into force 23rd October. These Regulations revise the certification regime applicable to United Kingdom fishing vessels, and non-United Kingdom fishing vessels operating in United Kingdom waters. The Codes of Practice deal with the safe operation, construction and equipping of fishing vessels. They implement Council Directive 93/103/EC of 23rd November 1993 concerning the minimum safety and health requirements for work on board fishing vessels and Council Directive 97/70/EC of 11th December 1997 setting up a harmonised safety regime for fishing vessels of twenty-four metres in length and over, as amended by Commission Directive 2002/35/EC.

 

Amending legislation

 Waste

 WSI 2017/1024. The Unauthorised Deposit of Waste (Fixed Penalties) (Wales)Regulations 2017.  Comes into force 24th October. These Regulations insert a new section 33ZB into Part II (Waste on Land) of the Environmental Protection Act 1990 (c.43) to enable an authorised officer of a Welsh waste collection authority to issue a fixed penalty notice for contravention of section 33(1)(a) of the Act in the area of the authority.  Section 33ZB allows a Welsh waste collection authority to specify a fixed penalty of not less than £150 and not more than £400. If no amount is specified by the waste collection authority, the amount of the fixed penalty is £200.

 SR 2017/202. The Waste Management Licensing (Amendment) Regulations (Northern Ireland) 2017. Comes into force 1st November. Amends Schedule 6 of Waste Management Licensing Regulations (Northern Ireland) 2003 (SR 2003/493).  Schedule 6 lists of offences.

Water

SSI 2017/321. The Public and Private Water Supplies (Miscellaneous Amendments) (Scotland) Regulations 2017.  Comes into force 26th October.  Makes very minor amendments to Schedules 1 and 2 of The Public Supplies Amendment Regulations 2014 (SSI 2014/364) and Schedules 1, 3 and 4 of The Private Supplies Regulations (SSI 2017/282).

SR 2017/212. The Water Supply (Water Quality) Regulations (Northern Ireland) 2017.  Comes into force 27th October.  These Regulations supplement the Water and Sewerage Services (Northern Ireland) Order 2006 and revoke and replace the Water Supply Quality (Northern Ireland) Regulations 2007 (SR 2007/147). They also revoke and replace the Water Supply (Water Quality) Regulations (Northern Ireland) 2010 and the Water Supply (Water Quality) Regulations (Northern Ireland) 2015.

 

Commencements

 SI 2017/942. The Energy Act 2016 (Commencement No. 4 and Transitory Provision) Regulations 2017.  Sections 30 to 36 of the Energy Act 2016, so far as they are not already in force, come into force on 21st October.

Consultations

Department for Environment, Food & Rural Affairs is consulting on ways to reduce litter and increase recycling / reuse of drinks containers, including deposit and reward and return schemes. The Department for Business, Energy & Industrial Strategy, Ministry of Defence, and Health and Safety Executive are, in combination, consulting on how to transpose the emergency preparedness elements of the Basic Safety Standards Directive 2013 (BSSD 2013) into UK law. This consultation is relevant to those working with radiological material, in particular where an emergency as a result of that work might have an impact on the public. The Department for Business, Energy & Industrial Strategy, The Welsh Government, The Scottish Government, and The Department of Agriculture, Environment and Rural Affairs (Northern Ireland) are, in combination, seeking views on the proposals for implementing the requirements of the 2013 Euratom Basic Safety Standards Directive (2013/59/EURATOM) in relation to planned and existing public exposure situations and the justification of practices involving ionising radiation.  The Directive lays down safety standards for protecting against the dangers arising from exposure to ionising radiation. The Department for Business, Energy & Industrial Strategy is consulting on plans to introduce a support programme to increase industry confidence in identifying and investing in opportunities for recovering and reusing waste heat from industrial processes and increase the deployment of recoverable heat technologies in industry. The purpose of this consultation is to:

test the proposed design of the Industrial Heat Recovery Support Programme (IHRS) gather additional evidence on the enablers and barriers to recovering industrial waste heat, to ensure the scheme is appropriately designed and maximises value for money start to identify a potential pipeline of projects from across industry sectors

The Department for Business, Energy & Industrial Strategy is consulting on proposals for Streamlined Energy and Carbon Reporting within the Companies Act 2006 business reporting framework. This consultation is asking for views on:

mandatory annual reporting and disclosure of energy and carbon information through Company Accounts who these requirements should apply to reporting of cost-effective energy efficiency opportunities, such as those identified through ESOS audits, and action taken on these complementary disclosures electronic reporting

Department for Environment, Food & Rural Affairs is consulting on plans to amend the UK’s 2013 regulations for waste electrical and electronic equipment (WEEE). The changes will include:

introducing “Open Scope” requirements, which extends the regulations to all electrical and electronic equipment unless specifically exempt making membership to the Producer Balancing Scheme compulsory changing how producer fees are allocated in the UK

New legislation

Conservation

 SI 2017/1012. The Conservation of Habitats and Species Regulations 2017. Comes into force 30th November. These Regulations consolidate the Conservation of Habitats and Species Regulations 2010 (SI 2010/490), with amendments, and make minor modifications reflecting changes to related legislation. They also implement aspects of the Marine and Coastal Access Act 2009 (c. 23). These Regulations transpose Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora.

SI 2017/1013. The Conservation of Offshore Marine Habitats and Species Regulations 2017. Comes into force 30th November.  These Regulations consolidate the Offshore Marine Conservation (Natural Habitats, &c.) Regulations 2007 (SI 2007/1842), with amendments, and make minor modifications reflecting changes to related legislation. The consolidation makes, amongst things, provision for implementing Council Directive 2009/147/EC on the conservation of wild birds and Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora in relation to marine areas where the United Kingdom has jurisdiction beyond its territorial sea. The Regulations make provision in relation to the offshore marine area, offshore marine installations and certain ships and aircraft. The “offshore marine area” is defined. The Offshore Marine Conservation (Natural Habitats, &c.) Regulations 2007 (SI 2007/1842), as amended, is revoked.

 

Environmental Protection

SI 2017/1050. The Environmental Offences (Fixed Penalties) (England) Regulations 2017.  Comes into force 1st April 2018. These Regulation replace the Environmental Offences (Fixed Penalties) (Miscellaneous Provisions) Regulations 2007 (SI 2007/175) as amended. The Regulations set fixed penalties for aspects such as nuisance from audible intruder alarms, waste receptacles and noise from commercial premises and litter, distribution of printed matter, graffiti and fly posting, abandoning vehicles, transporting waste and duty of care for waste.

 

Planning.

 SSI 2017/350.   The Town and Country Planning (Fees for Monitoring Surface Coal Mining Sites) (Scotland) Regulations 2017. Comes into force 1st January 2018. These Regulations provide for fees to be paid to planning authorities in relation to site visits made for the purpose of monitoring compliance with surface coal mineral permissions.  Regulation 3 specifies when a fee is payable and the amount to be paid.

 

Amending legislation

Energy.

SI 2017/1053. The Electricity Capacity (Amendment) Regulations 2017. Comes into force 1st November. These Regulations amend the Electricity Capacity Regulations 2014 (SI 2014/2043). Amendments are made with the connection to the de-rating of DSR CMUs, the settlement body is now permitted to make deductions under certain conditions and the requirement to maintain applicant credit cover until a CMU is achieved is entrenched. Schedule 2 amends the Supplier Payment Regulations so that the capacity market supplier charge and settlements costs levy will be collected based on “gross demand”, instead of “net demand”.

SI 2017/1143.  The Ecodesign for Energy-Related Products (Amendment) Regulations 2017.  Comes into force 1st January 2018.  These Regulations amend The Ecodesign for Energy-Related Products Regulations 2010 (SI 2010/2617) and partially implement Commission Regulations (EU) Nos 2016/2281, 2015/1189 and 2015/1185.  New entries to the table at paragraph 4 of Schedule 1 to SI 2010/2617 for the following products—

from 1st January 2018, air heating products, cooling products, high temperature process chillers and fan coil units; from 1st January 2020, solid fuel boilers; and from 1st January 2022, solid fuel local space heaters.

 

Environmental Protection.

SI 2017/1070. The Environmental Impact Assessment (Miscellaneous Amendments Relating to Harbours, Highways and Transport) Regulations 2017.  Comes into force 5th December. These Regulations implement Directive 2014/52/EU amending Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment. They relate specifically to harbour works (in England and Wales and Scotland), the construction or improvement of highways (in England and Wales) and certain transport related works (in England and Wales).  The amendments are to:

Harbours Act 1964 (c. 40) which makes provision for harbour revision and empowerment orders. Highways Act 1980 (c. 66) to provide for procedures governing the environmental impact assessment of projects for the construction or improvement of highways, mainly trunk roads, in England. Transport and Works Act 1992 (c. 42) and the Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 2006 (SI 2006/1466) which make provision for orders authorising transport-related works in England and Wales.

 

Water.

SI 2017/1042. The Water Abstraction (Specified Enactments) Regulations 2017. Comes into force 1st January 2018.  These Regulations specify enactments for the purposes of section 102(5)(b) of the Water Act 2003 (c. 37).  That section states that nothing in those specified enactments prevents the Environment Agency or the Natural Resources Body for Wales from granting an abstraction licence.

SI 2017/1044. The Water Abstraction and Impounding (Exemptions) Regulations 2017. Comes into force 1st January 2018. These Regulations provide for exemptions from the restriction on abstraction and the restriction on impounding works in the Water Resources Act 1991 (c. 57).

SI 2017/1046. The Water Abstraction (Revocations etc.) (England) Order 2017.  Comes into force 1st January 2018. This Order revokes Orders deemed to be made under section 33 of the Water Resources Act 1991 (c. 57) which were saved following the repeal of that section. Those Orders provided exemptions from the restrictions on abstraction of water set out in section 24 of that Act.

SI 2017/1047. my Water Abstraction (Transitional Provisions) Regulations 2017. Comes into force 1st January 2018. These Regulations contain transitional provisions relating to the licensing of water abstraction by certain categories of persons, in the light of amendments made by the Water Act 2003 (c. 37) to the Water Resources Act 1991 (c. 57). Those amendments limit or remove certain exemptions from the restriction on abstracting water in the 1991 Act.

SSI 2017/389.  The Water Environment (Miscellaneous) (Scotland) Regulations 2017. Comes into force 1st January 2018. This order amends Water Environment (Controlled Activities) (Scotland) Regulations 2011 (SSI 2011/209). General binding rules 3, 9 to 13, 15, 17 to 20, 23 and 24 in Part 1 of schedule 3 are amended and new general binding rules 25 to 28 are inserted into that part of that […]

New legislation

Environmental protection.

 

SI 2017/1200.  The Control of Mercury (Enforcement) Regulations 2017.  Comes into force (except Parts 2 and 3) on 1st January 2018. Parts 2 and 3 come into force on 1st April 2018. These Regulations supplement Regulation EU 2017/852 on mercury by establishing offences, penalties and enforcement powers relating to that Regulation. These Regulations also implement Article 17 of the Mercury Regulation which requires the designation of authorities responsible for performing functions under that Regulation. Part 2 provides for civil enforcement by the Environment Agency and NRW.  Parts 3 and 4 respectively provide for enforcement by DAERA and SEPA. Part 7 creates offences relating to the provisions of the Mercury Regulation which are listed in Schedule 1.

 

SI 2017/1248.  The Pollution Prevention and Control (Designation of Directives) (England and Wales) Order 2017.  Comes into force 8th December. This Order designates Council Directive 2013/59/EURATOM laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation and repealing Council Directives 89/618/EURATOM, 90/641/EURATOM, 96/29/EURATOM, 97/43/EURATOM and 2003/122/EURATOM and Directive 2015/2193/EU on the limitation of emissions of certain pollutants into the air from medium combustion plants as relevant directives for the purposes of paragraph 20(1)(b) of Schedule 1 to the Pollution Prevention and Control Act 1999 (c.24).

 

SSI 2017/446.  The Pollution Prevention and Control (Scotland) Amendment Regulations 2017. Coming into force 19th December. These Regulations amend the Pollution Prevention and Control (Scotland) Regulations 2012 (SSI 2012/360). These Regulations add provisions relating to medium combustion plants (“MCPs”). They transpose Directive (EU) 2015/2193 of the European Parliament and of the Council on the limitation of certain pollutants into the air from medium combustion plants, which lays down rules to control emissions of sulphur dioxide, nitrogen oxides and dust from MCPs. These Regulations also amend The Air Quality Standards (Scotland) Regulations 2010 (SSI 2010/204).

 

Radiation and radioactive substances

 

SI 2017/1075. The Ionising Radiations Regulations 2017. Coming into force These regulations revoke and supersede the Ionising Radiations Regulations 1999 (SI 1999/3232). Coming into force 1st January 2018.  The Regulations impose duties on employers to protect employees and other persons against ionising radiation arising from work with radioactive substances and other sources of ionising radiation. The regulations also impose certain duties on employees. The Regulations implement in part as respects Great Britain provisions of Council Directive 2013/59/Euratom laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation, and repealing Directives 89/618/Euratom, 90/641/Euratom, 96/29/Euratom, 97/43/Euratom and 2003/122/Euratom. The regulations make significant amendments to:

SI 1998/494.The Health and Safety (Enforcing Authority) Regulations 1998. SI 2001/2975. The Radiation (Emergency Preparedness and Public Information) Regulations 2001 SI 2009/1348. The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009. SI 2013/1471. The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 2013 SI 2016/253. The Health and Safety and Nuclear (Fees) Regulations 2016.

 

 

SR 2017/229. The Ionising Radiations Regulations (Northern Ireland) 2017. These regulations revoke and supersede the Ionising Radiations Regulations (Northern Ireland) 2000. Comes into force 1st January 2018.

 

 

Amending legislation

 

Energy.

SI 2017/1234. The Renewables Obligation (Amendment) Regulations 2017.  Comes into force 1st January 2018. These Regulations amend the following Orders —

the Renewables Obligation Order 2015 (S.I. 2015/1947) the Renewables Obligation (Scotland) Order 2009 (S.S.I. 2009/140) and the Renewables Obligation Order (Northern Ireland) 2009 (S.R. 2009/154).

 

These Regulations transpose, in relation to the Renewables Obligation Orders, amendments to Directive 2009/28/EC on the promotion of the use of energy from renewable sources made by Directive (EU) 2015/1513 amending Directive 98/70/EC relating to the quality of petrol and diesel fuels and amending Directive 2009/28/EC on the promotion of the use of energy from renewable sources.

SI 2017/1289.  The Renewables Obligation (Amendment) (Energy Intensive Industries) Order 2017. Comes into force 14th December. This order amends the Renewables Obligation Order 2015 (SI 2015/1947). Article 2 inserts a new definition of “EII excluded electricity”, electricity which is supplied to certain industrial users of into SI 2015/1947. Article 3 amends the provision imposing the renewables obligation in article 7(2) and inserts a new definition of “relevant electricity”. Article 8 inserts new articles 13A and 13B which cover the determination of the number of renewables obligation certificates to be produced by electricity suppliers.

 

 

SSI 2017/432. The Renewables Obligation (Scotland) Amendment Order 2017. Comes into force 8th December.  This Order amends the Renewables Obligation (Scotland) Order 2009 (SSI 2009/140).  This order adds new definitions and a new article 12A which contains a calculation for determining, in respect of obligation periods beginning on or after 1st April 2019, the number of renewables obligation certificates to be produced by a supplier. EII excluded electricity is excluded from the calculation.

 

Environment

 

SI 2017/1177.  The Environmental Damage (Prevention and Remediation) (England) (Amendment) Regulations 2017. Comes into force 1st April 2018.  These regulations amend the Environmental Damage (Prevention and Remediation) (England) Regulations 2015 (SI 2015/810) to devolve enforcement responsibility under the EU Environmental Liability Directive (2004/35/EC) in Welsh offshore areas, from the Secretary of State to Welsh Ministers.

New legislation

Energy

SI 2018/56. The Scotland Act 2016 and Onshore Petroleum (Consequential, Transitional and Saving Provisions and Model Clauses) Regulations 2018. Comes into force on commencement of section 48 of the Act. These Regulations make amendments and modifications to the existing regime for the licensing of petroleum consequent on sections 47 and 48 of the Scotland Act 2016 (c. 11), which devolve legislative competence to the Scottish Parliament and transfer certain functions and powers to the Scottish Ministers for the granting and regulation of licences to search and bore for and get petroleum within the “Scottish onshore area” and related matters.  These regulations amend SIs. 1995/1434, 2014/1686 and 2015/766.

 

Environmental protection.

 SI 2017/1312. The Environmental Protection (Microbeads) (England) Regulations 2017.  Comes into force 9th January. These Regulations prohibit the use of microbeads as an ingredient in the manufacture of rinse-off personal care products and the sale of any such products containing microbeads.

 

Radiation and radioactive substances.

SI 2017/1322.  The Ionising Radiation (Medical Exposure) Regulations 2017. Comes into force 6th February. These Regulations implement, as respects Great Britain, some of the provisions of Council Directive 2013/59/Euratom laying down basic safety standards for protection against the dangers from exposure to ionising radiation. The Directive repeals Directives 89/618/Euratom, 90/641/Euratom, 96/26/Euratom, 97/43/Euratom and 20013/122/Euratom. In particular, these Regulations transpose Directive requirements relating to dangers arising from ionising radiation in relation to medical exposure.

SI 2018/42.  The Nuclear Installations (Prescribed Sites and Transport) Regulations 2018.  Come into force 16th January. These Regulations prescribe the sites and transport for which lower liability limits apply under the Nuclear Installations Act 1965 (A1965 c.57).  The liability regime imposed by A1965 c.57 “the Act” on operators of nuclear sites and disposal sites taking nuclear waste sets the standard liability limit at €1200 million, but allows a lower limit to be set for sites and transport prescribed under section 16(1) of the Act. These Regulations do not apply to excepted matter, which is the subject of separate regulation, the Nuclear Installations (Excepted Matter) Regulations 2017 (SI 2017/920).

 Amending legislation

Environment

SI 2018/15. The Plant Health (Fees) (England) (Amendment) Regulations 2018.  Comes into force 8th February. These regulations amend the Plant Health (Fees) (England) Regulations 2014 (SI 2014/601).     Regulation 2 of these Regulations amends Schedule 2 of SI 2014/601 to give effect to the latest notification published by the European Commission of the reduced plant health checks which are applicable to certain plants and plant products.

SI 2018/71. The Plant Health (England) (Amendment) Order 2018.  Comes into force 14th February. This Order amends the Plant Health (England) Order 2015 (SI 2015/610) to implement Commission Implementing Decision (EU) 2017/2352 to prevent the introduction into and the spread within the Union of Xylella fastidiosa.

 

Road transport.

 SI 2018/52. The Road Vehicles (Registration and Licensing) (Amendment) Regulations 2018. Comes into force 19th February.  These Regulations amend the Road Vehicles (Registration and Licensing) Regulations 2002 (SI 2002/2742) to revise certain duties and other matters related to damaged motor vehicles.

Shipping.

SI 2018/53. The Merchant Shipping (Safety Rules and Standards for Passenger Ships) (Miscellaneous Amendments) Regulations 2018. Comes into force 15th February.  These regulations amend:

SI 2015/508. Merchant Shipping (Survey and Certification) Regulations 2015.  Definitions for “The Directive” and “pleasure vessel” amended. SI 2010/1075. Merchant Shipping (Technical Requirements for Inland Waterway Vessels) Regulations 2010. Minor amendment to regulation 3(3)(b). SI 2000/2687. Merchant Shipping (Passenger Ships on Domestic Voyages) Regulations 2000. A number of changes to regulation 2 (interpretation).

Revocation

SR 2018/5. The Offshore Electricity Development (Environmental Impact Assessment) (Revocation) Regulations (Northern Ireland) 2018.  Comes into force 2nd February.  This regulation revokes The Offshore Electricity Development (Environmental Impact Assessment) Regulations (Northern Ireland) 2008 (SR 2008/55).

Consultations

The Maritime and Coastguard Agency is consulting on a proposed scheme which will ensure minimum standards are adhered to among providers of marine oil pollution response services.  Consultation closes on 9 March. https://www.gov.uk/government/consultations/uk-national-standard-for-marine-oil-spill-response-providers.

DEFRA is consulting on a regime to enforce the EU Invasive Alien Species Regulation in England and Wales.  Consultation closes 3rd April. The EU Invasive Alien Species Regulation (EU 2014/1143) came into force in 2015. It currently applies restrictions on forty-nine invasive non-native species of most concern in Europe including a ban on keeping and sale. DEFRA is consulting on reducing crime at sites handling waste, and introducing fixed penalties for waste duty of care.  Consultation closes 26th March.   Changes being considered include enforcing more appropriate competence standards for permitted waste site operators and variations to waste exemptions to prevent them being used to hide illegal activity.
