SI 2026/3. The Employment Rights Act 2025 (Commencement No. 1 and Transitional and Saving Provisions) Regulations 2026. The following provisions of the Employment Rights Act 2025 (A 2025 c. 36) come into force on 8th January; Sections 1 to 6 and 8 and related Schedules 1 and 2 (zero hours workers), 9 (right to request flexible working), 16 and 17 (paternity leave), 18 (bereavement leave), 24 (harassment and discrimination), 26 (dismissal during pregnancy) and 27 (dismissal following period of statutory family leave). Also coming into force on that date Sections 28 to 30, 32 and 36 (collective redundancy) and specified provisions of Part 4 (trade unions and industrial action, etc) and Schedule 6 (trade union recognition). On 18th February sections 31 (collective redundancy notifications: ships’ crew), section 57 (maritime employment), 76, 77, 79 (industrial action) and 81 (annual returns).
