August 2024 news letter

In our newsletter for August 2024, we bring to you two amendments to UK legislation; goods vehicles and building safety and a commencement; Welsh planning.  Nothing of relevance was published for The Republic of Ireland or the EU. We have two new consultations raised during the period in question ; planning and changes to an EA standard rule. We list two prosecutions of note.

We have recently received a query about Extended Producer Responsibility.  This is a duty on organisations in the UK who supply or import packaging.  The Packaging Waste (Data Reporting) (England) Regulations 2023 (SI 2023/219), The Packaging Waste (Data Collection and Reporting) (Wales) Regulations 2023 (WSI 2023/798) and The Packaging Waste (Data Reporting) (Scotland) Regulations 2023(SSI 2023/7) impose requirements on producers who are established in those countries to collect data on the packaging they supply to others and, in some cases, report some of that information to the relevant Regulator (Environment Agency, Natural Resources Wales or SEPA). Guidance can be found at https://www.gov.uk/guidance/extended-producer-responsibility-for-packaging-who-is-affected-and-what-to-do#check-if-you-need-to-take-action  and https://www.gov.uk/guidance/how-to-collect-your-packaging-data-for-extended-producer-responsibility. These regulations extend producer responsibility laws in the UK covering packaging, electrical and electronic equipment (EEE), batteries and end of life vehicles (ELVs).
